Scotland's New Lobbying Act: What all Public, Private and Third Sector organisations need to do to comply

Scotland’s new Lobbying Act is expected to come into force later this year.

The Act requires that public, private or third sector organisations which have discussions about any of a range of Scottish Government or parliamentary activities with a Member of the Scottish Parliament, a Scottish Government Minister, a Scottish Government Special Adviser or the Permanent Secretary will be covered by the legislation. This includes circumstances when individuals working for such organisations may meet elected members or officials informally or unexpectedly.

After the Lobbying (Scotland) Bill was given Royal Assent in April 2016, it was intended that a ‘register of lobbyists’ would be fully operational within 18 to 24 months. A new Lobbying Registrar was appointed last October and the procurement process is well underway for the new IT system which will host the Lobbying Register. Guidance is also being developed by the Lobbying Registrar to assist with interpreting the rules and regulations of the Act.

  • What activities are covered by the Lobbying Act
  • How organisations and individuals are included in the Act and in what circumstances
  • What registration will be required and what information returns will then need to be undertaken to remain compliant
  • Which communications are exempt from the law
  • The new offences and fines created under the Act
  • Who needs to be aware of activities which count as lobbying under the Act - both organisations and individuals within them
