The Role of Regulators in Scotland
A Scottish law firm with national and international capability, Brodies has a reputation for uncompromising quality, expertise and innovation.
The size of our Public Sector Services Group (PSSG) and breadth of its experience is unique in Scotland. We assist our clients in addressing legislative, economic and political developments; driving improvement in services; securing value for money and delivering change.
Headed by Jackie McGuire, the PSSG continues to go from strength to strength. More than 70 solicitors from across the firm are now actively engaged in the delivery of services to the Scottish public sector.
Public sector budget cuts will pose a challenge for the development of new transport and community infrastructure and affordable housing. Brodies has been advising local government and public sector bodies on kick-starting strategic roads infrastructure. We have also been advising on a range of asset management initiatives, designed to maximise the value of public sector assets.
The Scottish Legal Complaints Commission are the independent gateway for all complaints about lawyers in Scotland, and able to adjudicate on cases up you £20,000 or to refer more serious issues for prosecution. We manage around 1,200 cases per year, and our services are free to those raising a complaint.
The Commission was established in 2007 following a Government review which recommended removing much of the complaint handling role from the traditional self-regulatory bodies.
Since 2016 the Commission has lobbied for further reform, presenting a series of innovative papers on the theme #ReimagineRegulation. These proposals were largely adopted by a recent 18 month independent review into regulation in the legal sector. The final report, entitled ‘Fit for the Future’, was published in October 2018, and a response by the Scottish Government is awaited.
